The full terms, in one place.
This is the binding agreement between you and Pesthouse for your Pesthouse Membership. No signature is required, by signing up to a Membership, you agree to these Terms.
1Parties and Definitions
1.1These Terms and Conditions (the Terms) govern the supply of a Pesthouse Membership (a Membership) by Blessman Corporation Pty Ltd (ABN 66 651 531 289), trading as Pesthouse (Pesthouse, we, us or our), to the individual purchasing or otherwise activating the Membership (the Member, you or your).
1.2In these Terms, unless the context otherwise requires:
- Annual Service means the complimentary annual service included with an active Membership, as described in clause 8.
- Australian Consumer Law or ACL means Schedule 2 to the Competition and Consumer Act 2010 (Cth).
- Business Day means Monday to Friday, excluding Queensland public holidays.
- Commencement Date means the date the first Membership Fee is successfully processed.
- Cooling-Off Period means the fourteen (14) day period commencing on the Commencement Date, as described in clause 5.
- Eligible Property means the residential property nominated by the Member for the Membership.
- Membership means the Pesthouse Membership subscription described in these Terms.
- Membership Benefits means the benefits available to an active Member, including but not limited to the Annual Service, Member Discounts, priority booking, and any other advertised inclusions.
- Membership Fee means the recurring monthly fee payable by the Member, as set out in clause 4.
- Member Discount means the additional discount available to active Members on eligible Pesthouse services.
- Retail Price means the standard advertised price charged by Pesthouse to customers who are not Members at the time the relevant service is performed.
- Service Area means the geographical areas serviced by Pesthouse from time to time, currently greater Brisbane and the Gold Coast, Queensland.
- Written Notice means notice provided by email, or any other written communication method approved by Pesthouse.
2The Agreement
2.1By activating a Membership, whether online, by phone, or in person, the Member agrees to be legally bound by these Terms and any Membership information published on the Pesthouse website at the time of joining.
2.2These Terms apply to the exclusion of any other terms proposed by the Member, unless expressly agreed in writing by Pesthouse.
2.3Pesthouse may update these Terms from time to time where reasonably necessary. Where a change materially affects the Member's rights or obligations, Pesthouse will provide reasonable notice before the change takes effect. Continued payment of Membership Fees after that notice period constitutes acceptance of the updated Terms.
2.4Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including any consumer guarantee under the Australian Consumer Law.
3Membership
3.1Membership is available to residential customers whose property is located within Pesthouse's current Service Area. Acceptance of a Membership application remains at Pesthouse's sole discretion.
3.2Membership commences on the Commencement Date and continues on a month-to-month basis until cancelled in accordance with these Terms.
3.3Membership applies only to the Eligible Property nominated at sign-up. Membership Benefits cannot be used across multiple properties unless expressly approved by Pesthouse.
3.4Membership is intended for normal residential use only and is not available for commercial, industrial, body corporate, or multi-site properties, unless otherwise agreed in writing.
3.5Membership is personal to the Member and may not be assigned, sold, or transferred to another individual without Pesthouse's prior written consent.
4Membership Fees and Billing
4.1The Membership Fee is $44.00 plus GST per month, unless otherwise advised by Pesthouse.
4.2Membership Fees are automatically charged each month using the Member's nominated payment method.
4.3The Member authorises Pesthouse, or its nominated payment provider, to process recurring Membership Fee payments until the Membership is cancelled in accordance with these Terms.
4.4The Member is responsible for ensuring payment details remain accurate and current. Failure to update payment details does not cancel the Membership or remove the obligation to pay Membership Fees.
4.5Where a Membership Fee cannot be successfully processed, Pesthouse may:
- attempt to reprocess the payment;
- suspend Membership Benefits until the account is brought up to date;
- postpone or refuse future bookings;
- recover any outstanding Membership Fees; or
- terminate the Membership where payments remain outstanding.
4.6Membership Fees already paid are non-refundable except where expressly provided under these Terms or required by law.
5Cooling-Off Period
5.1The Member may cancel their Membership within fourteen (14) days of the Commencement Date by providing Written Notice to Pesthouse in accordance with clause 6.1.
5.2Where no Membership Benefits have been redeemed during the Cooling-Off Period, Pesthouse will refund the first Membership Fee paid.
5.3Where the Member has redeemed the Annual Service during the Cooling-Off Period, the Member may still cancel the Membership. However:
- no refund of the first Membership Fee will be payable; and
- the Member must pay the difference between the Retail Price of the service received and the total Membership Fees paid before cancellation.
5.4The amount payable under clause 5.3 becomes immediately due upon cancellation and may be charged to the Member's nominated payment method.
6Cancellation
6.1Any Written Notice given by the Member to cancel the Membership under these Terms must be sent by email to booking@pesthouse.com.au, and must include the Member's full name, property address, and Membership start date. Notice is taken to be given on the date Pesthouse confirms receipt by return email.
6.2The Member may cancel their Membership at any time by providing Pesthouse with not less than two (2) months' Written Notice.
6.3Membership Fees remain payable throughout the notice period. The Member will continue to receive Membership Benefits during this period, provided all Membership Fees remain paid and the Membership remains in good standing.
6.4Where the Member has redeemed the Annual Service and cancels the Membership before completing ten (10) monthly Membership Fee payments, the Member agrees to pay the difference between:
- the Retail Price of the Annual Service received; and
- the total Membership Fees paid by the Member.
6.5Any amount payable under clause 6.4 becomes immediately due upon cancellation. Pesthouse may deduct this amount using the Member's nominated payment method or issue an invoice payable within fourteen (14) days.
6.6If the Member has not redeemed the Annual Service before cancellation takes effect, no additional payment will be required other than Membership Fees payable during the notice period.
6.7Pesthouse may terminate the Membership immediately by Written Notice if the Member fails to pay any amount due within 14 days of it falling due, breaches these Terms in a material way and does not remedy that breach within 14 days of being asked to do so, or engages in abusive, threatening, or unsafe conduct towards Pesthouse staff.
6.8Either party may terminate the Membership immediately if the other party becomes insolvent, has a liquidator or administrator appointed, or ceases to carry on business, in each case to the extent permitted by law.
6.9On termination of the Membership for any reason, the Member must provide reasonable access for Pesthouse to recover any equipment supplied in connection with the Membership within 30 days. Clauses 4.6, 6.4, 6.5, 9, 10, 11 and 13 survive termination of the Membership.
7Property and Transfer
7.1If the Member relocates to a new residential address within the Service Area, the Member may apply to transfer the Membership to that new address, provided the Member gives Pesthouse Written Notice before the relocation takes place. Pesthouse will use reasonable endeavours to accommodate the transfer but may decline or delay a transfer where the new address falls outside the Service Area or Pesthouse's then-current service capacity.
7.2Where a Membership is transferred to a new Eligible Property, the existing Membership Benefits continue to apply at the new property from Pesthouse's next scheduled visit. The transfer does not include, and the Member acknowledges they may need to separately book and pay for, any service that is specific to the condition or history of the new property, including (without limitation) an initial or introductory treatment, an end-of-lease treatment, or a termite inspection of a property not previously serviced by Pesthouse.
7.3A Membership is personal to the Member and may not be sold, gifted, or otherwise transferred to another person, whether or not that person resides at the same property, except as permitted under clause 3.5.
8Scope of Services
8.1Pesthouse will provide the Annual Service and other Membership Benefits described at pesthouse.com.au, using qualified, licensed technicians and using products and methods Pesthouse considers appropriate for the conditions encountered.
8.2The Member must provide Pesthouse's technicians with safe and reasonable access to the Eligible Property to carry out the Annual Service and any other booked service. If a technician attends the property at the agreed time and the Member (or another authorised adult) is not present, or access cannot otherwise be provided, and as a result the visit cannot be completed, that visit will be treated as the Annual Service having been provided for that year, and a once-off missed-appointment fee of $130 will apply, reflecting the loss of work and costs incurred by Pesthouse in attending. Pesthouse will provide reasonable notice of an upcoming visit so the Member can arrange access.
8.3Pest control and termite management are ongoing risk-management services, not guarantees against any pest or termite activity occurring. Results vary depending on factors outside Pesthouse's control, including the age and construction of the property, weather, neighbouring properties, and the Member's own use of the property. Any warranty referred to in Pesthouse's marketing material applies only on the terms stated in that material and does not constitute a guarantee that no pest or termite activity will occur.
8.4Where the Annual Service or any other booked service involves the installation of bait stations or similar equipment, that equipment remains the property of Pesthouse at all times during and after the Membership. The Member must not remove, relocate, open, or otherwise interfere with any such equipment, and must keep pets and children away from treated areas as advised by the attending technician. Pesthouse may recover the cost of replacing any equipment that is lost, damaged, or not made available for collection on termination of the Membership.
8.5Services outside the Annual Service, or services the Member requires more frequently than the Annual Service provides, may be booked separately at the Member Discount rate applicable to the Member's Membership.
9Member Obligations
9.1The Member must:
- provide accurate information at sign-up and notify Pesthouse promptly of any change to contact details, payment details, or the status of the Eligible Property;
- provide safe, reasonable, and timely access to the property for the Annual Service and any other booked service;
- follow Pesthouse's reasonable pre-visit and post-visit instructions, including any instructions provided in Pesthouse's service guide or by the attending technician;
- keep children and pets away from treated areas, equipment, and ladders as instructed by Pesthouse technicians;
- not interfere with, remove, or relocate any bait station or other equipment installed by Pesthouse; and
- treat Pesthouse staff with courtesy and respect.
9.2Pesthouse is not liable for any failure to perform the Annual Service or any other booked service, or for any reduced effectiveness of treatment, to the extent caused by the Member's failure to comply with clause 9.1.
10Liability
10.1Nothing in this clause 10 excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on the Member under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified. Where the ACL implies a guarantee or warranty into these Terms and prohibits its exclusion, but permits Pesthouse to limit its liability for breach, Pesthouse's liability is limited, at Pesthouse's election, to one or more of: supplying the relevant services again, or paying the cost of having the services supplied again.
10.2Subject to clause 10.1, to the maximum extent permitted by law, Pesthouse's total aggregate liability to the Member arising out of or in connection with the Membership and these Terms, whether in contract, tort (including negligence), under statute, or otherwise, is limited to an amount equal to the total Membership Fees paid by the Member in the 12 months immediately preceding the event giving rise to the claim.
10.3Subject to clause 10.1, to the maximum extent permitted by law, Pesthouse is not liable to the Member for any indirect, special, or consequential loss, or for any loss of profits, loss of revenue, loss of data, or loss of opportunity, arising out of or in connection with the Membership, even if Pesthouse has been advised of the possibility of such loss.
10.4Nothing in these Terms limits or excludes Pesthouse's liability for death or personal injury caused by Pesthouse's negligence, for fraud, or for any other liability that cannot be limited or excluded by law.
10.5Pesthouse is not liable for any loss or damage to the extent it arises from: pre-existing pest, termite, or rodent activity not caused or contributed to by Pesthouse; structural, plumbing, electrical, or other defects in the property; areas of the property to which Pesthouse was not given access; or the Member's failure to comply with clause 9.
11Privacy and Photographs
11.1Pesthouse collects and handles personal information in accordance with its Privacy Policy, available at pesthouse.com.au/privacy-policy, which forms part of these Terms.
11.2Pesthouse's technicians may take before-and-after photographs of treated areas for quality assurance, dispute resolution, and training purposes, and may use such photographs for general marketing purposes. Pesthouse will not publish photographs that identify the Member or the property's specific address without the Member's separate consent.
12Events Outside Our Control
12.1Pesthouse is not liable for any delay or failure to perform its obligations under these Terms to the extent that delay or failure results from circumstances beyond its reasonable control, including extreme weather, natural disaster, pandemic, government restriction, supply shortages, or industrial action. Pesthouse will reschedule any affected visit as soon as reasonably practicable.
13General
13.1Governing law and jurisdiction. These Terms are governed by the laws of Queensland, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from those courts.
13.2Entire agreement. These Terms, together with the details confirmed at sign-up, constitute the entire agreement between the parties regarding the Membership and supersede all prior representations, understandings, or arrangements.
13.3Severance. If any provision of these Terms is found to be void, illegal, or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
13.4No waiver. A failure or delay by Pesthouse in exercising any right under these Terms does not operate as a waiver of that right.
13.5Notices to the Member. Pesthouse may give notice to the Member by email to the address provided at sign-up, by SMS, or by post to the property address. Notice by email is taken to be received on the day it is sent, unless the sender receives a delivery failure notification.

Acknowledgement
No signature is required to enter into this agreement. By signing up to a Pesthouse Membership, whether online or by phone, the Member confirms that they:
- have read and understood these Terms in full;
- are authorised to enter into this agreement and to provide payment authorisation for recurring billing;
- understand the Cooling-Off Period and Cancellation provisions in clauses 5 and 6; and
- agree to be bound by these Terms.
Signing up to a Membership is itself the act of acceptance. Pesthouse does not require a separate signed document for these Terms to take effect.
